CRESCO GUIDES · BUYING FROM THE USA
You can buy and register Dubai property from California. The paperwork is not hard. The one mistake almost everyone makes is the apostille.
Most American buyers assume they need to be in Dubai to buy in Dubai. For off plan property you usually do not. For a ready resale property the transfer happens at a Dubai Land Department trustee office, and someone has to sign there. That someone can be a person you appoint by power of attorney.
For most off plan purchases: reserve the unit, sign the sale and purchase agreement electronically with the developer, and pay into the project escrow account by wire. The developer registers the contract with the Land Department. Many Americans complete an off plan purchase without ever appointing anyone.
For a ready resale: you can negotiate, sign the memorandum of understanding (Form F) electronically, and arrange funds. The final transfer is where you need to be present or represented.
In most countries an American document is made valid abroad with an apostille from the Secretary of State. The UAE is not a party to the Hague Apostille Convention; it does not appear on the Hague Conference's status table of contracting parties. An apostille alone will not make your power of attorney valid in Dubai. It needs full legalization.
| Step | Where | What happens |
|---|---|---|
| 1 | Your lawyer, in Dubai or the US | Draft a specific power of attorney, ideally bilingual Arabic and English |
| 2 | A US notary | You sign in front of the notary |
| 3 | County clerk and Secretary of State, where your state requires | The notary's authority is certified, as an authentication certificate rather than an apostille |
| 4 | US Department of State, Office of Authentications | Federal authentication of the state certificate |
| 5 | UAE Embassy in Washington | The embassy legalizes the document |
| 6 | UAE Ministry of Foreign Affairs, in the UAE | Final attestation so Dubai authorities accept it |
| 7 | A translator licensed by the UAE Ministry of Justice | Arabic legal translation if the document is not already bilingual |
An alternative is to sign before a UAE diplomatic mission in the United States, after which the document still needs Ministry of Foreign Affairs attestation in the UAE. Dubai Courts has been piloting remote notarisation by video for people outside the UAE; check whether it is available for your transaction before relying on it. Fees change, so confirm them at each step.
A general power of attorney invites trouble. A specific one gets accepted. It should name you and your attorney with passport details, identify the property by project, building, unit and plot number, and spell out each power: signing the memorandum of understanding, paying the price and fees, signing at the Land Department trustee office, receiving the title deed, and connecting utilities. Practitioners report the Land Department generally accepts powers of attorney under two years old and may ask for the original at the transfer; confirm both when you book.
Do not give a power of attorney to the agent selling you the property, or to anyone paid by the seller. The person holding your power of attorney can sign for your money. Appoint a lawyer or someone whose only interest is yours, limit the powers to this transaction, put an expiry date on it, and revoke it once the title deed is in your name.
Start the power of attorney the week you agree a price, not the week before transfer. The chain runs through four offices on two continents, and each one has its own queue. The single most common reason an American resale purchase slips is a power of attorney that arrives late or with the wrong unit number.
Funds for a resale transfer are usually paid by manager's cheques drawn on a UAE bank at the trustee office, or through a conveyancer's account. We cover the wire, the bank and the currency in how to transfer money from the USA to Dubai.
Yes. Off plan purchases are usually completed remotely with the developer. Ready resale transfers need you or your attorney present at a Dubai Land Department trustee office, which a legalized power of attorney allows.
No. The UAE is not a party to the Hague Apostille Convention. A US document needs notarisation, state and federal authentication, UAE Embassy legalization and UAE Ministry of Foreign Affairs attestation.
A lawyer or a person whose only interest is yours, never the seller's agent. Limit the powers to the specific property and transaction and set an expiry date.
Practitioners report the Land Department generally accepts powers of attorney under two years old, and some banks want them under twelve months. Confirm when you book the transfer.
Apostille status: Hague Conference on Private International Law, Apostille Convention status table, checked 14 October 2026, on which the UAE does not appear. Legalization chain: US Department of State Office of Authentications and UAE Embassy guidance as summarised by US authentication services.
